Delaware Covers an Annual Behavioural Health Well Check

  • House Bill 303, signed on 3 August 2022 and in effect since 1 January 2024, made Delaware require an annual behavioural health well check across commercial health insurance, Medicaid and the state employee health plan. The law defines it as a pre-deductible yearly visit with a licensed mental health clinician holding at least a master's degree, which must include a review of medical history, an evaluation of adverse childhood experiences and "use of a group of developmentally appropriate mental health screening tools".

For commercial carriers, the well check is reimbursed through the preventive visit codes 99381 to 99387 and 99391 to 99397, at the same rate those codes pay for other medical care, and a code used for the well check cannot be denied because it was also used for another service. In Medicaid, the Division of Medicaid and Medical Assistance must set billing codes at comparable rates. The well check can sit inside collaborative care, the primary care behavioural health model, co-location or another integrated primary care model, and can be paid through value-based arrangements if the carrier documents its value.

The law asks for screening tools but does not name them, so each practice chooses its own set by age. HiBoop sends the PHQ-A and SCARED for young people and the PHQ-9 and GAD-7 for adults, scores each on submission and keeps a client's yearly results on one chart, with CSV and PDF exports. It does not bill insurers or Medicaid for you.

  • Pre-Deductible, Every Year

An annual visit with a licensed master's-level mental health clinician, in effect since January 2024

  • Screening Tools by Age

A group of developmentally appropriate screening tools, plus medical history and adverse childhood experiences

  • Paid Like Preventive Care

Commercial plans pay through the preventive visit codes; Medicaid sets comparable codes

What HiBoop Does for Delaware Care Teams

  • Delaware pays for a yearly behavioural health check-up and funds treatment through its public divisions. HiBoop does the sending and scoring, so your clinicians can spend the visit on the conversation.

  • Screens Done Before the Well Check

Email the scales ahead of the visit, with reminders, so clients complete them at home and the scored results are ready when the visit starts. The screening part of the well check is then documented and dated.

  • A Set of Scales for Each Age

Choose the PHQ-A, SCARED and CRAFFT-2.1 for an adolescent or the PHQ-9, GAD-7 and TAPS for an adult, and send whichever fits the client in front of you.

  • Year-Over-Year Results

Each year's scores join the same chart, so the clinician can see what has changed since the last well check and use it to inform their judgement about next steps.

  • Exports for Your Records

Download results as CSV or PDF for the record, a referral or a value-based payment report. You can export the full account at any time.

  • Integrated Primary Care Teams

Delaware lets the well check sit inside collaborative care or other integrated models. Team and Network plans give primary care and behavioural health staff one shared account, with role-based access.

  • Scales for Teenagers

In Delaware a young person aged 14 or older can consent to voluntary outpatient mental health treatment. HiBoop includes the PHQ-A, the SCARED and the CRAFFT-2.1 for adolescent caseloads.

  • The Well Check in Commercial Insurance

    18 Del. C. s.3370E

All carriers subject to Delaware insurance regulation, including third-party administrators, must cover the annual behavioural health well check and pay it through the listed preventive codes at the rate paid for other medical care. Payment may be adjusted for non-physician clinicians only by a method no stricter than for other medical care. Copays, coinsurance and network rules can still apply.

  • The Well Check in Medicaid

    31 Del. C. s.531

Medicaid carriers must also cover the annual behavioural health well check at rates comparable to other medical care, and the Division of Medicaid and Medical Assistance must develop billing codes comparable to the preventive visit codes. Capitated, bundled and other value-based arrangements are allowed if the carrier can show the well check is valued fairly within them.

Delaware Consent Rules and Health Privacy

  • HIPAA sets the federal baseline. Delaware law decides when a teenager can agree to their own outpatient mental health care and what a parent can still decide. No law certifies software; these duties sit with your organization, and HiBoop provides safeguards that support them.

  • What Delaware law asks

    • Accept written consent to voluntary outpatient mental health treatment from a minor aged 14 or older, which binds the minor and their parents as if the minor were an adult; for a minor under 14, a parent, custodian or guardian must request and consent (16 Del. C. s.5003(f)(3))
    • Respect consent given on either side: a minor aged 14 or older cannot cancel a parent's consent to outpatient treatment, and a parent cannot cancel the consent the minor gave (16 Del. C. s.5003(f)(3))
    • Obtain a parent, custodian or guardian's consent before giving psychotropic medication to a minor, which a minor's own consent does not cover (16 Del. C. s.5003(f)(3))
    • Meet HIPAA's safeguard and breach notification duties, with a business associate agreement in place for every vendor holding protected health information
  • What HiBoop provides

    • A business associate agreement for HIPAA covered entities
    • Hosting for US customers in Google Cloud US regions, encrypted in transit and at rest
    • Role-based access, so you control which staff see a teenager's screening results
    • SOC 2 Type II certification, with our controls described on the trust page

Measurement-based care

…starts with what we measure, and how long.

Frequently Asked Questions

  • Does Delaware require measurement-based care?

Not as ongoing outcome tracking. Delaware does require insurers, Medicaid and the state employee plan to cover a yearly behavioural health well check that includes a group of developmentally appropriate screening tools, which is the closest thing to a statewide measurement rule we found. Repeating scales during treatment remains a clinical choice unless your payer contract asks for it.

  • Will HiBoop bill the well check for us?

No. HiBoop does not submit claims or connect to insurer or Medicaid systems. It sends and scores the screening scales and exports results as CSV or PDF, so your team can document the well check and bill it through its usual process.

  • Can a 15-year-old start therapy without a parent in Delaware?

For voluntary outpatient treatment, yes. Under 16 Del. C. s.5003, a minor aged 14 or older can give written consent to outpatient mental health treatment, and neither the minor nor a parent can cancel the consent the other gave. Psychotropic medication still needs a parent's consent. Confirm the details with your counsel; HiBoop's role-based access lets you limit who sees a young client's scores.

  • Is HiBoop HIPAA compliant for Delaware practices?

Yes. HiBoop is HIPAA compliant and covered entities can sign a business associate agreement with us. Whether a particular disclosure is allowed depends on your situation and on Delaware law as well as HIPAA, so check with your counsel.
